Law - Family Lawyer

A family lawyer represents people going through divorce, custody modifications, guardianship issues or issues relating to children with regards to divorce or custody. Family lawyers will also work closely with child support agencies to ensure that parents are paying child support as required by state law and the court systems. A family lawyer may work in a private practice on their own or may be part of a group of lawyers or partnership. Mediation may also be part of the responsibility of a family law attorney or the lawyer may represent the client in the mediation process.

Family lawyers will also probate wills and estates, handle power of attorney issues, advise clients on setting up wills, annuities and trust funds, as well as working on adoptions and other issues. Most of an attorney's day is spend working directly with clients or collaborating or meeting with other lawyers in family law cases. In some states an attorney can work with both parties in a family dispute provided they both agree whereas in others each party must be represented by a different family lawyer.

Family attorneys also have to prepare filings and pleadings and attend court to represent their clients. Most attorneys work to avoid the necessity of costly court battles and try to resolve issues with the clients through mediation, arbitration or other methods of dispute resolution. Some family lawyers are also collaborative lawyers that work specifically to reach agreement between the two parties before going to court. Family attorneys must have completed the state bar examinations and must have completed all necessarily educational requirements before starting in the field.

Common work activities include:

  • Meeting with clients to discuss aspects of the case or family legal action they are taking.
  • Advising clients on legal options with regards to the case. Ensuring that clients understand which options are in their best interest.
  • Mediating and negotiating with other attorneys to attempt to resolve issues with regards to the pending legal case.
  • Preparing legal pleadings, filing court documents and completing paperwork as it pertains to the case.
  • Attending court proceedings to represent clients in legal issues.
  • Advertising and networking with other attorneys and professionals to constantly expand the customer base.
